3-judge bench set to hear Sonko’s petition against Wiper Party

A three-bench consistuted to hear former Nairobi Governor Mike Sonko's application seeking orders to bar Wiper Democratic Party from replacing him in the Mombasa gubernatorial race is set to hear the matter Today, Monday, July 4.

The bench consisting of Justices Olga Sewe, Anne Onginjo, and Erastus Githinji in a notice issued to the parties indicated that the matter will be heard at the Mombasa Law Courts.

Last week, Chief Justice Martha Koome appointed the bench to hear and determine the matter .

"My instructions are to inform you that the honourable Chief Justice has received the original court file from the High Court in Mombasa further the CJ has empaneled a 3-judge bench to hear and determine the matter in Mombasa," the notice read in part.

Sonko sues IEBC

In the petition, Sonko has further sued the Independence Electoral and Boundaries Commission (IEBC) seeking orders to bar it from printing ballot papers for the Mombasa gubernatorial race ahead of the August 9 general election until his case is heard and determined.

Sonko also claimed that following the expiry of the 72 hours allowed by IEBC for the party to field a candidate to replace him, he was likely to suffer huge losses considering the amount of money and time he had invested in his bid to vie for Mombasa gubernatorial seat.
