Sonko files 20 video clips to appeal apex court ruling

Former Nairobi Governor Mike Sonko yesterday filed 20 video clips at the Supreme Court as evidence to convince the top judges to rescind their decision to uphold his impeachment.

When his application for review of the judgment was called out for directions on hearing, it emerged that Sonko had filed video clips as part of evidence in his case.

Among the video clips is one showing a High Court judge discussing how to compromise a case that was pending for determination

The issue emerged after lawyer Kevin Kokebe for Nairobi City County Assembly, which is listed as the First Respondent, indicated that he will seek to have the video clips expunged, since they were filed late.

“I have taken pains to go through the video clips in Volume 4 listed in Pages 511 to 524, which appear to adduce the certificate videos evidence. l doubt if the said certificates and footage can be used as we were served late when we had already filed our responses and submissions,” Kokobe said.

Kokebe made the remarks as he sought direction on whether he will be allowed to file supplementary submissions on the video clips.

Supreme Court Registrar Bernard Kasavuli said the issue raised on the video footage will be dealt with today when the case comes up for further directions to confirm whether parties have complied with pretrial directions.

Kasavuli gave the directive after establishing that some parties had not filed their pleadings to enable him fix a hearing date.

This is after the respondents, Nairobi County Assembly, Senate, electoral commission and others sought more time to file their responses and submissions.

Kasavuli allowed their request and ordered them to be filed by 11am yesterday.

He also ordered Sonko, through his lawyers led by John Khaminwa and Wilfred Nyamu, to file his submissions by close of business yesterday.

Directions come after Sonko returned to the Apex court, asking the judges to set aside their own decision three days after the appeal against his impeachment was dismissed.

In his application for review, Sonko wants Chief Justice Martha Koome to recuse herself from the matter on grounds that she had made remarks suggesting that those impeached should not be allowed to run.
