PS gets reprieve in wife battery case

State Department of Youth Principal Secretary (PS) Julius Korir, got a reprieve from the courts after he successfully applied for orders to stop the Director of Public Prosecutions (DPP) from prosecuting him for assaulting his wife.

The court also barred the Directorate of Criminal Investigations (DCI) from arresting Korir in connection with the alleged assault of his estranged wife Evelyn Koech while she was pregnant.

High Court Judge Charo Mrima on February 24,  while issuing the orders also stopped the police from arresting him.

“Pending the hearing and determination of the application before me, I restrain the DPP and the police from taking any further actions against Korir,” Justice Mrima ordered.

The PS has been fighting off attempts by DPP Noordin Haji to prosecute him for allegedly assaulting his wife.

Court documents show that his wife reported the assault incident to Hardy Police Station in Karen on November 20, 2018, under OB 40/20/11/2018.

A medical examination report dated November 20, 2018, revealed that Koech suffered bruises in the abdomen, the forearm and the legs while she was pregnant.

A P3 form, signed by the police surgeon based at the police headquarters also showed she sustained thorax and abdomen injuries.

“Swollen and bruised upper part of the bum… Sustained soft five injuries,” read the P3 in part.

In September last year, Koech made a separate report at the same police station, alleging she had been assaulted and injured again by the PS.

But Korir went to court and obtained orders barring the Director of Public Prosecutions (DPP) Noordin Haji pending the hearing and determination of his application in court.

And seeking restraining orders under the miscellaneous application No: E2915 of 2020, the court granted that the applicant (wife) is a protected and the respondent (PS) been asked to desist from stalking, abusing either by self or by his agents.

Korir and Ms Koech’s marriage is said to have cooled off a few years back, but things took a turn for the worst when claims of assault crept in 2018.

Already, Ms Koech has filed for divorce under application E015 of 2021 where Korir has now been given fifteen days to enter appearance or judgment be granted.

The PC also faces a separate case in the children’s court, No: MCCC/E945 of 2020 where he is being asked to pay school fees and upkeep for his children.

Korir previously served in the State Department of Infrastructure in the Ministry of Transport, Infrastructure, Housing, Urban Development, and Public Works having been appointed in February 2018.

Prior to this appointment, he served as the PS in the Ministry of Health and State Department of Investment and Industry in the Ministry of Industry.
