Baby Sagini pre-trial case set for March

The pre-trial conference in a case in which three people: Alex Maina Ochogo, Pacifica Nyakerario and Rael Mayieka (below, standing); have been charged with attempting to kill Brighton Sagini, will be heard on March 3.

Senior Resident Magistrate Christine Ogweno also directed media bloggers to stop prosecuting the case, saying it infringed on the privacy of Sagini and his sister Shantel Kemunto.

“Stop infringing on the rights of minors. You have to protect their privacy. This applies to social media,” she said.

 Lawyer George Morara told the court that one Esnas Nyaramba, a human rights activist, was violating the privacy of the minors on social media, adding that the children’s interests were paramount. He said the children were being counselled by experts to recover from the trauma and urged the court to give the counsel more time to record witness statements.

“Sagini is a key witness and is undergoing psychological debriefing alongside his sister. Their privacy should be respected,” Morara said.

Prosecutor Hilary Kaino gave the accused persons witness statements relating to the charges. The magistrate directed the trio to read the statements and look for lawyers to represent them ahead of the pretrial.

There was a light moment when suspect Ochogo said: “I have a problem sleeping (in the cells) and I want the witnesses to hurry up and testify to end my suffering”.
