Barasa loses petition to block probe

Kimilili MP Didmus Barasa yesterday suffered a blow after an anti-corruption court dismissed his bid to block the government from investigating him over claims that he was misusing a Kenya Defense Forces title.

Justice Esther Maina threw out the petition by the MP saying it was an abuse of the court process.

“In my view the petition is nothing more than an abuse of the court process. If indeed the petitioner is a retired Army Captain, nothing stops him from clarifying that position to EACC and to this court,” ruled Maina.

Barasa (pictured) wanted the High Court to quash a letter sent to him by the Ethics and Anti-Corruption Commission seeking to grill him after he claimed to be a retired Captain of the Kenya Air Force. The lawmaker also wanted the court to bar any prosecution in connection to the alleged impersonation.

EACC sought the matter to be dismissed on grounds that Barasa was misusing the title since investigations had established that he never earned that title during his service at the military between 2007 and 2009.

The commission claimed Barasa left the military at the rank of a private and not as holder of the title captain when he was dismissed in 2009.
