Blow to Waititu as DPP recommends more charges

The Director of Public Prosecutions (DPP) is seeking to recommend more charges in a case where former Kiambu Governor Ferdinand Waititu is charged with Ksh588 million.

In an application filed on September 29, 2021, the prosecution is seeking to amend the charges for further disclosure of additional evidence produced in court by the Ethics and Anti-Corruption Commission (EACC) officer Rahma Bishar who testified on September 30, 2021.

The State said that upon further review of the prosecution’s case and the evidence, it came to their attention that there was a need to amend the charge sheet and for further disclosure of additional evidence.

"That the proposed amendment and substitutions of the charge sheet is crucial to enable this honourable court in arriving at the truth of the matter and making a fair and just determination of the case," the application read in part. 

They added that on June 17, 2021 the prosecution served to the accused persons their counsel’s additional documents.

The prosecution told the court that the application was being made in good faith and would not prejudice any party.

The former governor through his lawyer John Swaka opposed the application.

Anti-Corruption magistrate Thomas Nzioka said he will deliver a ruling on the same on November 3, 2021.
