Court blocks farmer’s bid to open road land parcel

An 80-year-old prominent farmer’s bid to seek court redress to compel his neighbors to open an access road into his 20 acres parcel of land that was closed five years ago hit a snag after the Eldoret Lands and Environment Court ruled against his prayers.

Following the court verdict, for William Barmasai and his family to access their home from the main road, they will be forced to go through a water pan stretching about two kilometers away from the closed oad trespassing through neighbor’s land.

In his ruling, Justice Elijah Obaga stated that the mere fact that Barmasai’s family have been using the disputed access road for a long time is no justification for the same to be declared as being the official access road.

“If the court was to order that parcel No.260 should be accessed through the disputed area, the effect of this would reduce the defendant’s land,” said Justice Obaga in his verdict.

Justice Obaga said that when the court visited the two parcels of land, it was noted that the disputed access road passes through the land owned by the defendants.

The Judge observed that parcel No 260 owned by Barmasai has a stretch measuring about seven metres through which his family can access their land.

“Although the plaintiff and his witnesses had claimed that there is a water pan on the intersection at parcel 260, 261 and 264, the court observed that there was no water and the plaintiff’s family could easily access their land through the 7 metre stretch which touches the main road,” ruled the Judge.

Barmasai moved to court where he sued his neighbors led by Catherine Rono and Kipkoech Rono after they closed the access road which he uses to access his home.

According to Barmasai, the access road had been existing and was being used by his family since the 1960’s adding that its closure was not justifiable.

He claimed that the defendants cut down trees which were along the disputed access road that were planted by his late father.

But in their rejoinder, the defendants who include Gideon Rono, Magdalene Chepchirchir , Rita Chelimo, Kipngetich Rono and Onesmus Kiplagat stated that the disputed access road does not exist as claimed by their accuser. They contended that Barmasai’s family should access their land through a six metre stretch at the lower part of their property.

The two properties are adjacent to each other. Justice Obaga said that he based his ruling on a report from the County Surveyor after he ordered the official to visit the two parcels owned by the family of the plaintiff and that of the defendants.

The mission was to determine whether there exists a road of access on the disputed area and whether the parties are entitled to the reliefs sought.

“The county surveyor did visit the ground and prepared a report. The surveyor observed that according to the Registry Index Map ( RIM ), there is no access road to parcel No.260 which is owned by the Barmasai family. The surveyor observed that parcel No 260 could be accessed on the lower part which borders parcel 261 and 242,” said Justice Obaga.
