Court nullifies nomination of two Murang’a MCAs

A Murang'a court has nullified the nominations of two members of the county assembly in the gender top-up list.

This follows the hearing and determination of a petition filed by a few residents seeking the nullification of the nomination of 12 members to the Murang'a county assembly on claims that there were irregularities in their appointment.

The petitioners; Joseph Njoroge, Risper Nyambura, Jane Wanjiki, Rose Muthoni and Angela Mueni claimed that they were denied the chance to be nominated to the assembly and instead their names were swapped.

In the petition, Independent Electoral and Boundaries Commission (IEBC), UDA and 12 nominated MCAs; Damaris Muthoni, Hannah Wairimu, Pauline Muchiri, Jane Mukami, Gladys Wambui, Prisca Njeri, Mark Gicheru, Anthony Marubu, Sherleen Wambui and Julian Njiiri were listed as the respondents.

The petitioners claimed that the first list of the candidates who had been listed for nomination by the leaders in Murang'a county was tampered with as it was different from the one published by the IEBC.

They also said two of the nominees did not qualify for the positions as they were not registered voters in the county.

Further, the petitioners argued that seven out of the 12 nominees come from Kiharu constituency thus there was no regional balance as some areas were not given a single slot.

In its defense, however, the IEBC through the legal office said it was not involved in the listing of the nominees as that was the work of the party.

UDA on its part through the chair National Elections Board Anthony Mwaura said the party submitted the list of nominees to the IEBC but the first list was rejected because of non-compliance.

The party did the second list on 24 August which was adopted and published by the commission

The party also said the claims that the two nominees are not registered voters in Murang'a were mere allegations that had not been backed by any evidence.

Senior Resident magistrate in her ruling delivered virtually with all the parties present said the nomination of Prisca Njeri and Julian Njiiri was null and void.

Further, she directed that the IEBC reallocates the gender top-up seats to the next females in the Murang'a county register.
