Court orders release of sureties in Akasha sons’ case

A Mombasa court has ordered the release of sureties of three relatives of two convicted sons of slain drug baron Ibrahim Akasha and a co-accused Indian national Vijagiri Goswami.

Mombasa Chief magistrate Martha Mutuku ordered the release of title deeds that had been used to secure the release of Baktash Akasha and Ibrahim Akasha who have been convicted of 25 and 23 years in prison, respectively, after pleading guilty in a US court to drug trafficking charges.

The title deeds belonging to Adil Nazf Daud Nurdin, Nurdin Akasha Abdalla, and Rayan Mohammed Abdalla had been deposited in court following the arrest of the two suspects in 2014.

The trio had sought the orders seeking to have, the title deeds released to them arguing that the two whom they had stood surety had since left the jurisdiction of the country following their extradition in the year 2017.

They argued that they needed the titles in their custody to develop and dispose of some of the properties.

“Our legal duties and obligations as sureties can no longer be met because the subjects of our sureties were extradited to the United States, charged, convicted, and imprisoned,” they informed the court.

They also stated that because they have fully discharged their individual duties as sureties, they no longer wish to have their properties held as surety for individuals whose attendance in court in Kenya is impractical due to their residence in another jurisdiction.
