CS Magoha orders schools to refund excess fees

Education Cabinet Secretary Professor George Magoha has directed schools that charged fees outside the guidelines to refund parents or treat the extra funds as prepayment of fees for continuing students.

In a statement to schools on Tuesday, August 10, Magoha through Education Principal Secretary Paul Kibet said that no child will be sent away from school for not paying fees adding that institutions should display their fees structure on their notice boards.

The PS further directed schools that wish to charge fees above the stipulated amount to make a formal request to the Cabinet Secretary after which authorisation will be granted to them.

The statement by the Ministry of Education comes days after parents complained of hiked fees stating that schools are charging fees beyond the stipulated amount.

“The Ministry has received numerous complaints from parents, sponsors of needy students and the general public regarding schools charging illegal levies,” the circular read in part.

The recommended fees for national schools is set at Ksh 45,054, county schools at Ksh 35,035 while day schools are free.

The PS further emphasized that no person or Board of Management in a public institution of basic education and training should alter or increase fees without written authority from the Cabinet Secretary.

Through the circular, the Ministry of Education further stated that no public school or institution should issue alternative fees structures other than those approved by Magoha.

While quoting the Basic Education Regulations of 2015 Section 44, 45 and 46 on free and compulsory education, the PS said that the members of the Board of Management of an institution that contravenes regulation 44 or 45 shall jointly and severally be guilty of an offence under the Act.

The PS has also placed on notice County and Sub County Directors to report to the Principal Secretary any Board of Management whose institution is charging illegal levies with immediate effect noting that any unreported case(s) of a school(s) charging illegal levies will attract sanctions.
