Director of Public Prosecutions: I’ve new evidence in Kuria case

Director of Public Prosecutions (DPP) Noordin Haji has requested a Nairobi court to allow him introduce new evidence in the hate speech case against Gatundu South MP Moses Kuria.

Through his assistant Kennedy Panyako, the DPP said eight witnesses whose statements had gone missing from the original police file  had been found.

Trial magistrate Kennedy Cheruiyot heard that the statements had been found at the National Cohesion and Integration Commission offices after a mistake in filing and that there was need to introduce new witnesses after the eight indicated that they were not ready to testify in the case.

“Their evidence is crucial to this court. We are seeking the court to compel them to come and give evidence,” said Panyako.

But the MP, through lawyer Geoffrey Omenke, objected to the DPP’s application, saying it would be pre-judicial to him. 

So far, four witnesses have testified in the case in which Kuria was charged with uttering words aimed at bringing death and physical injury to persons in Kenya on June 26, 2015.

Last December, the DPP was directed to establish who stole witness statements.

Kuria, meanwhile, accused the Director of Criminal Investigations George Kinoti of interfering with the case.
