The High Court yesterday issued second summons for former Investigating officer Frank Onunda to appear in court on August 5 to testify in the trial of six people charged with the murder of former Juja MP George Thuo.

Justice Roseline Korir issued the summons after Onunda failed to comply with initial summons requiring him to clarify certain issues that arose during the cross-examination of lead investigating officer, Chief Inspector Maxwell Otieno.

Following his failure to attend court, defense lawyers, led by Dr John Khaminwa opposed the prosecution’s request to have the case adjourned.

Khaminwa told the court that the suspects continue to suffer prejudice. “My lord, the accused have so far suffered economically and socially due to delay of this case,” he said.

The accused include Paul Boiyo alias Sheki, Thuo’s aide, Christopher Andika alias Lumba, DJs Andrew Wainaina and Samuel Ngugi alias Visi, waiter Esther Mulinge and patron Ruth Irungu alias Atlanta.  They have denied poisoning Thuo (pictured) at Porkies Bar in Thika town on November 17, 2013.  Onunda was among  investigating officers in the case and appended his signature on the memo and inventory.
