Former nominated Senator writes to IEBC seeking election date changed
Former Nominated Senator Paul Njoroge has written to the Independent Electoral and Boundaries Commission (IEBC) Chair Wafula Chebukati and the Attorney General of Kenya asking for the postponement of the August 9, 2022, General Elections.
According to a letter seen by People Daily Digital, Njoroge wants the elections pushed to August 2023 since, by the already set date, President Uhuru Kenyatta’s tenure would not have expired.
He says denying the Head of State his full term is unconstitutional hence the need to have the date changed so that he can serve fully.
“If elections are to be conducted on the 9th August 2022, as you have indicated, it means that the current president shall have been denied over 4 months of his term, which is unconstitutional,” he said.
“The current office holder of the President of the Republic of Kenya was sworn into the office on the 28th November 2017. It, therefore, goes without saying that the term of the office of the president shall expire on the 27th November 2022,” Njoroge added.
The former senator has given the IEBC 30 days ultimatum to announce fresh elections dates or he moves to court to seek interpretation of the constitutional provisions of the Elections Act.
“I believe that under the proper interpretation of the law the correct date of the next election shall be on August 2023, not 9th August 2022. Unless you, withdraw and desist from misinforming the public that the election date is 9th August 2022 within the next 30 days, I shall be constrained to move to court and seek the court’s interpretation of the above constitutional provisions,” he said.
