Fresh petition seeks to compel Kidero to refund Sh58 million
The Ethics and Anti-Corruption Commission (EACC) has lodged a fresh petition at the High Court seeking to compel former Nairobi Governor Evans Kidero and 13 others to refund Sh58 million.
Commission, through investigating officer Mulki Umar, wants the embattled governor, Nyakach MP Joshua Owuor, former Nairobi Mayor John Ndirangu, Kidero’s former aide George Wainaina and their accomplices to refund the monies they received from lawyer Stephen Mburu, who died in 2018.
Kidero is expected to return Sh14 million he received through Cups Limited (Wainaina and Son company) in January 7, 2014.
Cups Limited is said to have received Sh15 million from Mburu, trading as Wachira, Mburu, Mwangi and company advocates before transferring Sh14,400,000 to Kidero.
EACC avers that Kidero is liable to account to the commission and the county Sh14,400,000, which he fraudulently acquired from the Cups Limited herein being part of Sh58 million irregular and illegal paid to M/s Wachira Mburu Mwangi and Co Advocates on January 7, 2014 by Nairobi County Government being public funds.
“The plaintiff avers that on behalf of Nairobi City, the county is entitled to directly trace the aforesaid amount of Sh 14 million and claim equitable title to service apartment (known as Gem Apartment) on LR Number 205 of 46 located within Riverside, which was constructed on the instructions and payments by Kidero with knowledge that the said assets were traceable to proceed of crime and tainted property,” says Umar
New move by EACC to recover the funds arose in 2011 following a suit filed in court against the Nairobi City council by Kyavee Holdings.
Commission says that on or about October 14,2014 they received a report of alleged corruption at the Nairobi county government (former city council of Nairobi) wherein it was alleged that the said office was involved in processing irregular and illegal payment of Sh58 million.
