Kamket acquitted as DPP fails to prove Olmoran incitement case

Tiaty MP William Kamket was yesterday acquitted by a Nakuru court in a subversion case after the prosecution failed to prove its case.

Chief Magistrate Edna Nyaloti in her ruling noted that despite the court granting the State enough time to prove the case, it failed to produce witnesses.

Nyaloti observed that the matter which has been in court for close to 10 months could to kick off as the Prosecution applied for numerous adjournments.

“It is clear the prosecution is not ready with this case. The court therefore acquits the accused person,” ruled Nyaloti.

The prosecution, after being granted the last adjournment, had applied to have Kamket (pictured) acquitted under section 87(a) which the court declined.

“The withdrawal of the case by the prosecution is not allowed. Under this section, any withdrawal of the case must be with the consent of the court, which was not the case,” said Nyaloti.

She also cautioned the DPP against abuse of the court process saying the numerous adjournments and subsequent application of withdrawal was unwarranted.

Kamket had been charged with subversion and incitement in September 2021 in connection to armed attacks in Olmoran area in Laikipia last year.
