Leaders fault lawyers’ advice to Koome in War Memorial Hospital case

Nakuru Town East MP David Gikaria and Nakuru Town West MP Samuel Arama have criticised the Law Society of Kenya, Nakuru branch, accusing them of insincerity in handling the War Memorial Hospital case.


They claim the lawyers misled Chief Justice Martha Koome (pictured), and the courts, on defiance of court orders, insisting the county government complied with the order to vacate the facility, contrary to the lawyers’ representation.


Gikaria in a presser revealed that the letter by the Chief Justice on the War Memorial case and judges recusing themselves from handling the matter was purely based on misinformation adding that a lot of facts including police inaction during the lawyer’s procession to the county offices was untrue.


“It was clear that after the court issued an order for the county to vacate the facility they did so, and handed over the management back. The lawyers are insincere and it is not good for the wheel of justice,” said Gikaria.


Gikaria said as much as lawyers are officers of the court, they should allow the courts to decide once the matter is in court, adding that the directors of the facility and land officials are already in court over forgery insisting that the public land will remain to members of the public.


On his part, Nakuru Town West MP Samuel Arama said there was no evidence that the county still manages the facility adding that all their enforcement officers guarding the facility had been removed to effect the order.


Chief Justice Martha Koome on Friday took issue with Nakuru County Government and the police for failing to obey and implement six court orders that would see operations at the hospital resume. Two judges have recused themselves from the case.
