Miguna wants Omamo jailed over failed homec*ming trip

Deported lawyer Miguna Miguna wants Foreign Affairs Cabinet Secretary Raychelle Omamo jailed for contempt of court. Through lawyer Adrian Kamotho Njenga, Miguna accuses Omamo of breaching court orders that had directed her to ensure he obtained emergency travel document from Kenya’s High Commission in Ottawa, Canada, or the High Commission in Berlin, Germany.

Miguna wants Omamo committed to jail for six months for blatant breach of orders of the court and violation of the Constitution.

In November last year, the High Court directed the Canada-based lawyer to obtain travel documents, if he intended to travel to Kenya, because an Identification Card was not a travel document. In his suit papers, Miguna claims that in spite of being duly served and aware of the court order and notice of penal consequences, the CS had failed to comply.

He argues that the refusal to obey a valid court order qualifies the CS for a maximum level of punishment.

“Unless this court urgently intervenes, there is real danger that the CS and the rest of respondents will continue to disregard valid court orders and recklessly drive the country into the trenches of anarchy,” he argues in court documents.

Miguna says he was rudely treated in Berlin by officials at the High Commission, who refused to receive a copy of the Court Order he presented to them.

“They walked out of the conference room they had ushered me into without issuing me with the emergency travel document,” he says in the documents. He claims he spent Sh430,000 on air fare and Sh340,000 on hotel accommodation and other basics.
