CoB suspends funds payout to assembly

The wrangles at the Kiambu County Assembly have escalated after the Controller of Budget stopped financial disbursements to the institution following a standoff between the Speaker and some MCAs.

This is after a section of MCAs wrote to the CoB Dr Margaret Nyakang’o (pictured) asking her to suspend any disbursements to the Assembly.
The MCAs argued that the current county clerk, Simon Rugu was unlawfully appointed and hence should not exercise the powers and functions of a clerk, who is the accounting officer of the Assembly.

In a letter to the County Assembly Speaker Stephen Ndicho, the CoB directed the former to confirm the lawful clerk of the County Assembly by December 17, 2021 “In the interim, all requisitions from the County Assembly shall be held in abeyance pending the resolutions of this issue,” states the letter copied to the Cabinet Secretary Treasury and CECM Finance and Economic Planning Kiambu. The MCAs maintained that John Mutie is the substantive clerk who was lawfully recruited and appointed by the County Assembly Service Board.

Meanwhile, all the 14 MCAs who were suspended by the speaker early this month over misconduct have since been allowed back into the Assembly by the High Court.

Milimani Principal Magistrate A.N Makau said nobody should bar them from accessing Assembly precincts pending the hearing and determination of the application before the court slated for December 20, 2021.
