Embakasi East MP Babu Owino is this morning expected to be  charged with attempted murder.

If found guilty of the offence, the MP could be imposed with capital sentence.

A detective privy to the investigations said a file had also been compiled and is to be forwarded to the Director of Public Prosecutions for directions before the MP is arraigned over attempted murder.

The MP spent the weekend in police custody following the shooting of a disc jockey at B-Club in Nairobi on Friday morning.

 Piecing evidence

Over the weekend, police were piecing together evidence in preparation for his prosecution.

He was arrested and taken to Kilimani Police Station and later transferred to Gigiri, where his fingerprints were to be taken.

Detectives are also said to have visited Owino’s Kileleshwa residence and the scene of crime where they recovered nine rounds of ammunition and a spent cartridge respectively , as exhibit awaiting analysis by ballistic experts.

On Saturday, the lawmaker is said to have been taken to the Government Chemist where his DNA was taken for analysis.

DJ Evolve, who was involved in the gun drama, is recuperating at the Nairobi Hospital.

Babu Owino’s lawyer Cliff Ombeta, claimed his client took Evolve to hospital and that he did not shoot the DJ.

Ombeta further disclosed that Owino had sent his wife to clear the DJ’s Sh600,000 hospital bill and has promised to foot all the bills accruing from his treatment.

It also emerged that Owino had attempted to use some close aides to negotiate with the family of DJ Evolve for an-out-of-court settlement.

The MP had said stated that his life is in danger and that he has been “living under the weight of intimidation and threats by my political opponents’.”

In a statement posted on his Facebook account on Friday, Babu Owino said: “A few weeks ago, I made a public statement regarding threats that I had been receiving against my life.

At the turn of the year, I reported an attempted assassination at the Parliament Police Station under OB number OB21/17/11/2019 at 17:28hrs.”

Aggressive people

“Yesterday was the culmination of these efforts by my enemies. While enjoying the company of my friends at a popular Nairobi restaurant, I was surrounded by a large group of aggressive individuals. In the melee, there was an exchange of gunfire,” he added.

He urged relevant authorities to conduct their investigations without fear or favour, adding that he was confident that the truth will come out in the long run.

“I urge my supporters to remain calm. I will continue to serve wananchi fearlessly. This will not deter me from supporting President Uhuru Kenyatta and Raila Odinga in the journey to transform our country,” he added.
