High Court orders man to keep off Karen land ‘gift’

The High Court has restrained one Eric Agolla Lugalia from interfering with a parcel of land situated in Karen, which he alleges to have been given by former President Daniel Moi.

Justice Samson Okong’o also directed officer in charge of Karen Police Station to ensure maintenance of law and order in the said land which belongs to businessman Stuart Gerald Cullinan Herd.

Suffer harassment

According to documents filed by the businessman, on May 20 this year, Lugalia was seen at the land and after interrogations he claimed he was given the land by Moi.

The applicant says that as a result of the trespass he has suffered inconvenience and unjustified harassment by the National Police Service following Lugalia’s allegations that he owns the property.

“That although I am still in physical and actual possession of the property. I’m apprehensive based on the past incidence that the defendants by himself or with armed gangs will yet again, unless restrained by the court, invade,” read court documents. The case will be heard inter partes on June 22.
