London Distillers gets reprieve after court stops developer Ederman

London Distillers Kenya (LDK) Limited yesterday won a reprieve after a High Court in Makueni issued orders stopping housing developer Ederman from continuing with construction at a site in Athi River.

The ruling by Justice CJ Mbogo set aside a ruling made last year allowing the developer to continue with the construction after they obtained an order from the Land Court in Makueni in December.

Yesterday Mbogo in the order stopped any further construction by the company after LDK following appealed a ruling by the lower court on January 20, 2019.

“Order be and is hereby issued staying the Ex Parte Order issued on 20th Janury of December, 2019 on interim basis pending ruling on the notice of motion application dated 9th January, 2020…Ruling shall be delivered on 06 March, 2020,” read the ruling by Justice Mbogo.

A ruling by the National Environmental Tribunal in Nairobi last year halted the construction of the homes pending the determination of a matter raised by LDK who challenged the construction of residential houses near the factory.

LDK were shocked to learn about the construction activities near their factory and moved to court.

The distilling company prayed for the matter after it took a long time for the developer to move to court and even then, they moved to court and failed to disclose that the matter was already in court.

LDK challenged the same in a Machakos Court.
