NLC wants land occupied by Del Monte resurveyed

The National Land Commission (NLC) has recommended that the land held or occupied by Del Monte Kenya Limited be resurveyed to establish if the company is in possession of a parcel that it is not registered against.

The commission further recommends that the surplus land should be surrendered and given to the Kandara Residents Association for resettlement and the County government of Murang’a take the remaining parcels for public purpose in the ration 70:30 respectively.

Committee Acting secretary who appeared before the National Assembly Lands Committee Kabale Tache Arero said the NLC advised in the alternative where no surplus land is discovered, the County government of Murang’a should retain adequate amounts of land for settlement of the Kandara residents and for public purpose upon expiry of the leases.

Del Monte should also surrender all public utilities within the land to the relevant National and County government agencies whether the leases expired or not.

But when the Del Monte management appeared before the committee yesterday, they said  they could not discuss the issue as it was before court.

Company lawyer Njoroge Regeru told the committee that there were seven cases in court challenging the petition filed by the Kandara residents.

He further told the committee that Del Monte was not opposed to resurveying of the land as directed by the commission as attested by a letter to the Director of Survey on June 12 this year.

“There are seven litigations running currently some of which were filed by the petitioners themselves and therefore it will be unprocedural to proceed with the committee hearings on matters which are before the court,” Regeru told the Rachel Nyamai-led committee.  “We are ready to appear before you once the matters in court are determined in the next one month,” he added.

Fair litigation

“It is clear that the petition by Kandara Residents Association is sub judice and the same is tailored to prejudice the fair of the litigations including the very suits instituted by the petitioner,” said Regeru  who was accompanied by the Del Monte managing director Stergios Gkaliamoutsas.
