Parliament dissolution: PSC to challenge Maraga’s advisory in court
The National Assembly through the Parliamentary Service Commission (PSC) has termed the Chief Justice (CJ) David Maraga's advisory to President Uhuru Kenyatta to dissolve the parliament as unconstitutional.
Led by their chairperson Speaker Justin Muturi, PSC on Tuesday said CJ Maraga wants to plunge the nation into a constitutional crisis.
"The Parliamentary Service Commission pursuant to its constitutional mandate and under the request of the two Speakers(Senate and National Assembly) has resolved to engage the the council to immediately proceed to the High Court to revert this unconstitutional action," said Mututi at the parliament buildings.
Speaker Muturi said their decision to move to the court was informed after a consultative meeting with Senate Speaker Ken Lusaka.
On Monday, the Chief Justice advised the President to dissolve Parliament over its failure to pass the two-thirds gender rule.
"In the result, your Excellency, it is my constitutional duty to advise you, the President of the Republic of Kenya, which I hereby do, to dissolve Parliament in accordance with Article 261(7)," CJ Maraga wrote in a letter to the President.
