A Thika Seventh Day Adventist (SDA) church elder,  who has accused his pastor of having an affair with his wife yesterday moved to court to stop a prosecution case against  him.

According to court papers, the elder who claims his local church pastor had a three-year affair with his wife claims he is being victimised for allegedly speaking out on the alleged adultery.

In the petition filed at Milimani Law Courts, the elder says that in December  2019, he learnt that his wife was having an extra-marital affair with the pastor.

Through lawyer Danstan Omari, he wants the court to stop their imminent arrest and prosecution for false allegations of defamation brought against them by  the pastor, whom he also accuses of threatening  him and other elders with unspecified consequences.

Speaks out

It is said that the pastor has reported them to the DCI and that they might be arrested anytime for speaking out the truth.

“That in the interim and pending hearing and determination of this application, this Honorable Court be and is hereby Pleased to issue a conservatory order restraining the CKC from remunerating the pastor,” says Omari in court papers.

The elder further wants the court to stop the leadership of the Central Kenya Conference from paying the pastor’s salary until the matter in heard and determined.

The petitioners, and other church elders, on diverse dates, wrote protest letters conveying a vote of no confidence to the East Africa Union Conference and Central Kenya Conference on the manner the case had been handled saying it “put the entire SDA Congregation to ridicule and disrepute.”

“..the aforesaid letter elicited no response, they instead learnt that the erring pastor had been reinstated and was on active payroll of the Central Kenya Conference treasury,” reads the petition.

Mwaura also asked the court to suspend the decision by CKC that overturned the decision by the local church to remove the pastor from the church register for committing adultery.

Further, the petitioners says that the Executive Committee of the Central Kenya Conference subsequently sat and in a bizarre turn of events exonerated the pastor in what allegedly left the entire SDA perturbed.
