Pet*tioners seek to nullify Finance Bi*l

A petition has been filed seeking to declare all transactions in Parliament, including the Finance Bill 2023, a nullity in law, since the Kenya Kwanza Coalition is a minority party.
In the lawsuit filed by 12 voters filed at Milimani High Court, the petitioners state that Azimio la Umoja Coalition is the majority party in the House as it has 171 MPs against Kenya Kwanza’s 165 arising from last year’s election.
The petitioners state that any business transaction endorsed by the Kenya Kwanza Coalition since October last year was of no legal consequence.
The case arises from a ruling by National Assembly Speaker Moses Wetang’ula (pictured) on October 6, 2022, declaring Kenya Kwanza the majority coalition.
“The ruling by Wetang’ula has triggered a constitutional crisis in Kenya that the minority party in the House has taken over the House Business Committee and other committees which have now prepared the Finance Bill 2023 and attendant Budget and Appropriations Bill 2023 that are insensitive to the economic suffering ravaging Kenyans and have violated all the principal of fair taxation,” the petitioners say.
They add that the constitutional basis of taxation goes hand in hand with the attendant rights of the citizens to be represented in the government and its arms and organs.
