Waititu wants court to reinstate him as Kiambu governor

Former Kiambu Governor Ferdinand Waititu now wants the court to declare his impeachment null and void.

Waititu moved to court seeking to regain control of Kiambu County about two years after he was removed over gross misconduct and abuse of office.

Through his lawyers Wildred Nyamu and Charles Njenga, Waititu asked the High Court to kick Governor James Nyoro out of the office and reinstate him (Waititu) as the county chief.

He argued that his impeachment process was unlawful and a violation of the constitution by the Kiambu County Assembly. According to him, the county assembly did not follow the due process to ouster him.

Justices George Dulu, Grace Nzioka and Wildrida Okwany heard that the MCAs did not meet the quorum during Waititu's impeachment process. There were only 57 MCAs present in the House during the impeachment, Waititu's lawyers said

"Six of the MCAs were in Dubai, two were absent without apology, three were away in UAE while 30 were absent," Nyamu said.

Since the passage of the impeachment motion was illegal, according to him, he now wants the court to declare Governor Nyoro's swearing-in as a violation of the constitution hence null and void.

"The petitioner has a right to get back to his office as if he was never removed. There was no impeachment," the lawyer said.

Nyamu further argued that Waititu was the people's choice and should not have been unlawfully removed from office.
