Reprieve as court bars Linturi’s arrest

The High Court has stopped police from arresting and charging Meru Senator Mithika Linturi over  claims he forged signatures to secure a Sh530 million bank loan using properties belonging to his estranged wife Marianne Kitany.

In a Judgment by Justice Hedwig Ong’udi, the court faulted the DCI for only acting on Kitany’s complaint while ignoring Linturi’s when he recommended that he be charged with forgery.

“DCI should also consider the complaint by the petitioner and to resubmit the file to the DPP within 90 days,” ruled the judge.

Linturi (pictured) moved to court to stop his arrest, claiming it was only meant to assist his estranged wife in the fight over multi-million properties.

He claimed police want to arrest him over a civil dispute matter. At the centre of the dispute is Atticon Limited, a firm that Linturi fully owned before ceding 50 per cent shares to Baron Estates Ltd, associated with Kitany.
