State given seven days to charge Mwendwa
The government has been ordered to charge suspended President of Football Kenya Federation Nick Mwendwa within seven days.
Mwendwa (pictured) is facing corruption allegations over alleged fraudulent acquisition of public funds.
The development comes after Milimani Senior Resident Magistrate Wandia Nyamu yesterday declined application by the prosecution to detain him for 14 days at Gigiri Police Station pending ongoing investigations into alleged misuse of public funds at the federation.
“The grounds in the Notice of Motion dated November 15 by the State are not sufficient to keep Mwendwa in custody for 14 days. I therefore decline the application by the State and hereby direct the prosecution to charge the suspect within seven days from today,” said Nyamu.
While dismissing the application, Nyamu said it was not in good faith to seek another 14 days to continue holding the FKF boss without a holding charge.
Fishing expedition
Magistrate accused the prosecution of being on a fishing expedition for evidence when they arrested Mwendwa over the weekend without having completed probe into the matter.
The court extended the Sh7 million bond or a cash bail of Sh4 million issued on Monday against Mwendwa for seven days pending his formal charging. Nyamu further noted that police defamed Mwendwa in public domain by alleging that they were investigating him over an alleged loss of Sh513 million yet what is contained in the affidavit was over Sh37.5million.
The government, through Evelyne Onuga, did not comment on the figures on Monday when they sought to have Mwendwa detained for two weeks. Case will be mentioned on November 25 to confirm if the State will have preferred charges against Mwendwa or the case be closed.
