Trouble brews for Kemsa boss over contempt

The Chief executive officer of the Kenya Medical Supplies Authority (Kemsa) Terry Ramadhani could find herself in trouble following revelations that she was irregularly appointed to the position.

Ramadhani also faces a contempt suit for going against a court order barring her from advertising the positions of the agency’s Director of Legal Services.

Frederick Wanyonyi, the agency’s Director of Legal had gone to court seeking orders to bar the CEO from advertising his position.

Lady Justice Maureen Onyango had ordered that, pending the inter parties’ hearing and determination of the application, the CEO stop any implementation of the decision made by the board.

However, Ramadhani went ahead in total disregard of the orders and advertised the position yesterday.

Wanyonyi meanwhile moved to court yesterday seeking to have Ramadhani cited in contempt for disregarding the orders.

Yesterday, the agency advertised 387 positions in the ongoing restructuring process which seeks to reduce the bloated workforce.  

In the petition filed by Lawyer Nelson Havi, Ramadhani attended the agency committee meetings in which her recruitment was being discussed and deliberated upon even after she had resigned from Kemsa.

“Under the circumstances, there was clear conflict of interest and illegality on her part and that of Kemsa for entertaining such an act,” reads the petition filed in the Employment and Labour Relations Court and certified as argent.
