Two charged afresh with Sh28m fake MoH tender
A businessman and a woman were yesterday charged with obtaining over Sh28 million from a businessman through a fake Ministry of Health tender.
The duo is accused of obtaining the money by pretending that they were in a position to secure him a tender from the Ministry of Health to supply hospital equipment.
George Otolo Aketch and Mercy Waihiga Wanjiku alias Linda Masaka, who appeared before Milimani senior resident magistrate Zainab Abdul were charged afresh with fraud and forgery after the prosecution consolidated the charge sheet.
At the same time, the magistrate ordered Aketch to add Sh170,000 to his previous bail of Sh30,000 to make it Sh200,000 pending the hearing of the case on April 12.
The prosecution alleges that on May 8, 2020 at Digital Marketing Ltd, located at Danhill Building in Westlands, Nairobi, the accused persons jointly with others not before court, obtained from Ibrahim Aden 1,000 pieces of non-contact infrared thermometers valued at Sh5.7 million by falsely pretending that a Tender No:MOH/DPPH/DNMP/001/GF- ONT/2019-2020 and a local purchase order (LPO) s/no 832489 both purported to be from the Ministry of Health.
The two are also accused of obtaining from Ibrahim Aden 1,640 boxes of non-powered hand gloves valued at Sh7,415,000 by falsely pretending that a tender dated May 4, 2020 and a local purchase order both purported to be genuine to enable the complainant to supply goods to the ministry.
They are accused of forging a letter of the Ministry of Health purporting it to be a genuine letter of notification of award for tender issued by the MOH.
Mercy is separately charged with unlawfully making an instrument capable of making the impression of a stamp for Principal Secretary, Ministry of Health.
She is further charged with obtaining from Ibrahim Aden Sh1 million by falsely pretending that the said money was meant to be an inducement for her to accept the consignment of hand gloves which was below standard required by the Ministry of health.
