Two United Millers’ directors charged with Ksh79M fraud

Two directors Sunil Narshi Shah and Kamal Narshi were charged together with Henry Musyoka Kavita and Sales manager Magnesh Kumar Varma and United millers.

Two Directors of United Millers and three employees of the company have been put on their defence to defend themselves in a case they are charged with conspiracy to defraud B.N Kotecha and Sons limited of Ksh79 million by failure to supply sugar.

City court Chief Magistrate R.A Oganyo in her ruling said the prosecution had established a pre-mafacie case against the suspects.

"I'm satisfied that the prosecution have established a case to warrant the suspects to be put on their defence. I hereby order all the accused persons to defend themselves in the matter," Oganyo ruled.

The prosecution counsel Eve Onuga had called a total of 11 witnesses before closing her case.

The lawyer of the accused persons Mr Gitonga indicated to court that they intended to call five witnesses during the defence hearing and asked the court for more time to supply to the prosecution details of the witnesses.

According to a charge sheet presented in Court on Tuesday, 27 April , the two directors Sunil Narshi Shah and Kamal Narshi were charged together with Henry Musyoka Kavita and Sales manager Magnesh Kumar Varma and United millers.

They were accused that on April 2, 2015 at unknown place within the Republic of Kenya, they  jointly conspired with intent to defraud B.N .Kotecha and Sons limited of Ksh79 million by falsely pretending that they had lost business as United Miller’s LTD to their clients by failure to supply sugar.

They are currently out on a cash bail of Ksh400,000 .
