Wangusi contract not renewable, CA boss tells court

The Communications Authority of Kenya (CA) board of directors chair Ngene Gituku yesterday said the contract of Francis Wangusi as director-general ended on August 21 and it was not renewable. 

In an affidavit filed in the Employment and Labour Relations Court, Gituku said CA appointed Wangusi on June 23, 2015 for a term of four years and the contract expired on August 21, this year.

“Wangusi was aware his contract was to end on August 21 and it was not renewable since he was serving a second term,” he said.

Gituku said he wrote to the State Corporations Advisory Committee (SCAC) seeking advice on the appointment of an acting DG pending the recruitment of a substantive office holder. 

He said he forwarded a list of CA staff, who are eligible for appointment to the post in an acting capacity and their qualifications.

Gituku added that SCAC advised them to appoint Mercy Wanjau to act for a period of one year.

The response by CA comes days after Wangusi said he is ready to vacate office and hand over to a “procedurally-appointed” successor.

In court documents, Wangusi said it is his constitutional obligation not to hand over the office in circumstances that violate the law.
