We will get the final word – Junet, Waweru to seek Supreme Court ruling on BBI
Proponents of the Building Bridges Initiative (BBI) led by its secretariat, Suna East MP Junet Mohamed and former legislator Denis Waweru have vowed to seek legal address on the bill from the Supreme Court.
Through a press conference held on Thursday, August 26, the two said they will move to the highest court in the land after the Court of Appeal sustained the High Court ruling which declared the bill null and void.
“There are those who believe very strongly that BBI is pursuing a just cause and that is being resisted in the same way the push for a return to multipartyism and the struggle for a new Constitution among other landmark changes have been resisted in the past and that the promoters should proceed to the highest court of the land for a final word,” Waweru said.
In the much awaited August 20 ruling, the appellate court presided over by Justice Daniel Musinga flagged down the bill after it felt to meet the requirements of Article 257 of the constitution.
In his statement to the media, Waweru said the BBI proponents seek a favorable ruling from the Supreme Court that will lead to enactment of the proposals in the bill.
“We believe that the Supreme Court has a wider and a more encompassing mandate when dealing with matters of great national interest than the High Court or the Court of Appeal,” Waweru argued.
In the August 20 ruling, Justices Musinga, Kiage, Tuiyott and Nambuye rendered a majority verdict upholding the Constitutional Court judgment that stated primary constituent power with regard to eternity clauses could only be invoked through a four-phased process entailing civic education, public participation and collation of views, Constituent Assembly debate and ultimately, a referendum.
