Nick Mwendwa lawyers decry his re-arrest

Football Kenya Federation (FKF) President Nick Mwendwa lawyers have denounced the re arrest of their client saying it is in 'bad faith'.

Mwendwa lawyers led by Eric Mutua termed the events as abuse of both police powers and the criminal justice system, whose aim was to intimidate the embattled FKF boss.

"The chronology of events shows a clear abuse of both police powers and the criminal justice system, whose ultimate aim is to intimidate our client in order for him to abandon his pursuit of a civil dispute over the management of FKF," Mwendwa's lawyer Eric Mutua said.

Mutua further said if Mwendwa is not released, then they shall hold the police involved accountable for false imprisonment, unlawful confinement, abuse of police powers and violation of Mwendwa rights.

"Note that unless our client is granted a cash bail, we shall hold you all concerned officers individually and or personally liable for false imprisonment, unlawful confinement, abuse of police powers, abuse of office and violation of rights," Mutua said.

Mwendwa was re-arrested and held at the Directorate of Criminal Investigations Headquarters earlier today.

FKF CEO Barry Otieno confirmed that the embattled FKF boss was re-arrested by detectives just a day after the state dropped corruption charges against him.

Mwendwa was initially arrested on November 12, spent a weekend behind bars but was released on a bail of Ksh 4 m as investigations continued.

Nairobi magistrate Wandia Nyamu dismissed the case after prosecutors, who had applied for 7 days to enable them to conduct investigations, sought to close the file against him.

"I therefore order this matter closed," Nyamu said, ordering that 42-year-old Mwendwa be refunded his bail payment.
