Businessman files second petition for Haji removal

The Director of Public Prosecutions (DPP) Noordin Haji is walking a tight rope after a second petitioner wrote to the Public Service Commission (JSC) seeking his removal from office over abuse of office and nepotism.

In the petition, the businessman Francis Nyaga Njeru accuses the DPP of failing to act constitutionally in a Sh150 million land case against businessman Ahmed Rashid Jibril and his wife Farah Ali Mohamed.

Nyaga accuses Haji of abuse of office, nepotism, favouritism, corrupt practices, bias, discrimination, incompetence, interference with the independence of the Judiciary, obstruction and inordinate delay of justice.

The first petition was filed by late Dutch tycoon Tob Cohen’s sister Gabrielle Van Straten who accuses the DPP of mismanaging her late brother’s case. 

In the latest petition, Nyaga says that he was defrauded his four acre parcel of land by Jibril, who he claims is the DPP’s close relative.

The city businessman says in the petition that the two directors of ARJ Capital were recommended to be investigated and prosecuted by the Director of Criminal Investigations (DCI) on orders of Justice Bernard Eboso. 

The city businessman is in dispute with China Road Bridge Corporation and ARJ Capital over the prime property located at Kyangombe village in Embakasi, Nairobi county.

The two firms were charged in January 2020 for conspiracy to defraud, making a false document, and obtaining registration of land by false pretences but the DPP has been making several attempts to have the criminal case against them withdrawn.
