Court allows DPP plea in fugitive case

A Nairobi court yesterday allowed the Director of Public Prosecutions (DPP) Noordin Haji to file written submissions in an extradition case, where a Kenyan is wanted in the US over Sh120 million money laundering claims.

Milimani Chief Magistrate Micheni Wendy allowed the DPP’s application to file written submissions after dismissing an application by fugitive Abdulrahman Imraan Juma (pictured), who sought to cross-examine witnesses in the extradition case. Juma, through his lawyer Kiraithe Wandungi had asked the court to compel the DPP to summon the witnesses so that he could cross-examine them. But in her ruling, the magistrate noted that the court cannot direct the DPP how to conduct his case.

“The DPP has powers to choose how he wants to conduct any criminal case before court without seeking permission from anyone,” said the magistrate. Juma,is being detained at Gigiri Police station since December 15,2021 after he was arrested by detectives from DCI headquarters, Kiambu Road. The DPP is seeking to to extradite Juma as requested by the US Department of Justice.
