Former IEBC boss put on defence in Sh1.3b graft case

A Nairobi court yesterday put former IEBC chief executive James Oswago on his defence in a Sh1.3 billion corruption case.
Milimani Anti-Corruption Court Senior Principal Magistrate Felix Kombo said Oswago and his former deputy secretary Wilson Kiprotich, listed as second accused, have a case to answer in respect of abuse of office charges.
But the magistrate acquitted two other co-accused, Edward Kenga and Willy Gachanja,who are former IEBC finance manager and procurement manager, saying the evidence presented by the Ethics and Anti-Corruption Commission could not support the charges against them.
Prove case
He said the court agreed with lawyer Kirathe Wandungi’s submissions that the prosecution had failed to prove a prima facie case against Kenga and Gachanja.
The four had been charged with abuse of office and failing to comply with procurement regulations relating to the acquisition of electronic voter identification kits, most of which failed during the 2013 General Election.
The case will be mentioned on June 16.
