High Court reinstates Isaac Mwaura as Senator after expulsion from Jubilee
Former nominated Senator Isaac Mwaura can now breath a sigh of relief after the High Court in Nairobi reinstated him as a Senator.
In his rulling, Judge Joseph Sergon declared the decision by Jubilee to expel Mwaura from the party as illegal stating that due process was not followed.
“This court is satisfied that the appellant was not accorded a fair hearing notwithstanding the fact that that the appellant did not apply for adjournment of the hearings of the disciplinary committee,” he said.
The judge then directed Mwaura who appealed his expulsion from the rulling party to be reinstated as a Senator.
“This court has come to the conclusion that the Jubilee Party’s National Disciplinary Committee processes and the decision that follows was unlawful,” the Judge said.
Before his expulsion, Mwaura was representing Persons With Disabilities as a nominated Senator. He was also serving as a member in the Speaker's panel.
Mwaura formally lost his seat in May 2021 after Senate Speaker Ken Lusaka declared his seat vacant through a gazette notice.
In February, Jubilee's National Management Committee (NMC) expelled Mwaura on grounds of indiscipline alongside five other Senators.
The five are Mary Yiane, Waqo Naomi Jilo, Omanga Millicent, Prengei Victor and Iman Dekow.
