Embattled Malindi Member of Parliament Aisha Jumwa and her bodyguard Geoffrey Otieno, will remain in police custody until Thursday, before they take murder plea.

A Mombasa court yesterday ruled that the duo be locked up at the Port Police Station, pending their appearance in court after undergoing a mental assessment.

Issuing the orders, High Court Judge Njoki Mwangi explained that the previous anticipatory bail issued to the two by the lower court, was no longer applicable and could not secure their freedom in the murder charge.

 “The consideration upon which they were released is null and void, and the bond terms cannot be used in this matter,” she ruled.  

First bond

Defence lawyer Jared Magolo had filed an application asking the court to take into consideration the fact that a lower court had released his clients on bond.

Justice Mwangi, however, maintained that the terms under which the first bond was granted, had nothing to do with the charge the two are set to face.

She added that Jumwa and her co-accused are at liberty to move the lower court to be refunded the anticipatory bail they deposited last October. 

The duo had been granted the anticipatory bail pending conclusion of investigations in the case.

Justice Mwangi ordered that the two be escorted to the Coast General Hospital tomorrow for mental evaluation. 

Coast region head of the Office of the Director of Public Prosecution, Alloys Kemo told the court that the two had proved not to be reliable as they had failed to show up at the Coast General Hospital for mental assessment last week, despite assuring the investigating officer that they would do so.
