Kapseret MP finally charged, released on bond
Police have formally presented their charges, two weeks after his arrest and subsequent incarceration at the station.
The charge sheet said that on September 7 at an unknown location within the Republic of Kenya, he used threatening words likely to stir up ethic hatred among communities.
He faced a second count of hate speech where he is alleged to have used threatening words on social media at an unknown place and on YouTube channel on September 7 likely to stir up ethnic tensions.
According to the charge sheet, Oscar Sudi is alleged to have demeaned the head of State by claiming that he was frustrating Deputy President William Ruto despite the latter having helped him to get to power.
Sudi is alleged to have dared the president to arrest all Kenyans allied to the DP expressing his concerns they are being politically sidelined despite voting him in.
The third count is that of offensive conduct committed on the same date he used abusive words against the Head of State and his family which was likely to cause a breach of peace.
He denied the charges and through his lawyers led by Kipkoech Ngetich and Collins Kiprono urged the court to be released on reasonable bond terms claiming Sudi was not a flight risk and was willing to attend court proceedings.
According to Ngetich, the prosecution must provide compelling reasons to deny their client bond adding that being a distinguished member of the society as an MP all his places of abode in Nairobi and Eldoret are well known.
He further prayed for orders that the court allows his client to dispense his attendance during mentions dates and allow counsels to instead attend saying he may be engaged in Parliament, an application denied by the prosecution.
“Our client has been heeding to police summons, as his advocates will follow up on the full compliance of the terms.
We also want to be supplied with all documents, witnesses statements to be relied upon by the prosecution,” said Ngetich.
In her ruling, the magistrate adopted the bond terms issued by the High Court releasing the accused on a Sh1 million bond, a surety of the same amount.
