Killer cop on the run implicated yet in another murder
A police constable who allegedly disappeared after he was accused of killing a man in May 2016 has again been implicated in the abduction and killing of another person.
A Nairobi court yesterday issued a warrant of arrest for Constable Carlistus Apalia, formerly of Huruma Police Station and his three colleagues said to be behind the disappearance of Philip Ondiro, who was last seen on February 1, 2015.
According to the Independent Policing Oversight Authority, Constables Apalia, Francis Githonga, Samwel Makori and Alex Munene are to be charged with the offence of abducting in order to murder.
Investigations revealed that the four, armed with guns, stormed a house in Kiamaiko within Huruma, Nairobi, pulled out Ondiro, bundled him into a waiting car and drove off.
“The investigation established the incident amounted to criminal culpability and recommended to the ODPP, the prosecution of officers suspected of involvement.
The ODPP concurred with the authority’s recommendations that the four officers be charged with the offense of abducting in order to murder,” IPOA said yesterday.
Clear distinction
One of the accused officers, Constable Apalia, with his other colleague, Constable David Lenkaldayo, had been accused of killing Stephen Mwihaki in Huruma in May 2015.
The two went underground and the matter was closed in May after the prosecution failed to arrest and charge them for four-and-a half years.
The deceased was hosted by his brother overnight and on the fateful day, his brother left at 5.30am and instructed him to drop off the keys at a local slaughterhouse.
As he went to deliver the keys at around 8am, a commotion ensued and he was shot dead by the two constables.
Case was investigated by IPOA and forwarded the file to the Director of Public Prosecutions. DPP concurred with IPOA’S recommendations that murder charges be preferred against the two.
The information in the murder case was filed in court on May 17, 2016 but the police service did not present the suspects in court. A warrant of arrest for the two was sought.
Matter was mentioned several times in court between December 7 2016 and March 1, 2017.
The then Starehe OCPD Alice Kimeli explained to court under oath that all the efforts she and her officers had made in an attempt to trace and arrest the subjects failed.
She further informed the court that the two had absconded duty and could not be traced even in their rural homes.
