Uhuru memo tabled in court in Sh63b dam scam cases

Retired President Uhuru Kenyatta was yesterday mentioned in the Sh63 billion Kimwarer and Arror dams scandal case.

Lawyer Katwa Kigen who represents Kerio Valley Development Authority (KVDA) boss David Kimosop yesterday tabled in court a Cabinet Memorandum signed by Uhuru, who was then Deputy Prime Minister and Finance Minister.

The memorandum was intended to appraise the Cabinet in regard to the formulation of projects through sustainable exploitation of the natural resources such as rivers and large water bodies among others, in line with Vision 2030 objective.

Kigen, while cross-examining State witness Charity Muyu, a procurement officer at KVDA, yesterday asked her to confirm whether Uhuru signed the said memorandum to which she replied in the affirmative.

The said Memorandum was also signed by then Minister for Regional Development Authority Fred Gumo and his Environment colleague, the late John Michuki, on December 1, 2008. Uhuru signed it on August 4, 2009 as the then Finance Minister and Deputy Prime Minister.

Prosecution argues that former Treasury Cabinet Secretary Henry Rotich, Kimosop and other accused arrogated upon themselves the right to float tenders for both projects and changed the character of the same and saddled the government with the debt of the cost of construction.

Case proceeds today.
