Court upholds order barring sale of governor’s property
Samburu Governor Moses Lenolkulal has suffered yet another major blow after the High Court declined to set aside an order barring him from selling four plots in Karen.
Justice John Onyiego ruled that the court was satisfied that Ethics and Anti-Corruption Commission (EACC) had met the criteria for issuance of the orders sought.
He also declined to suspend earlier orders that froze the Governor’s two bank accounts at Kenya Commercial Bank.
“It is true that the commission will suffer irreparable damage or loss should the properties be disposed or funds withdrawn as there will be nothing left to forfeit and recover in the event that the suit succeeds,” ruled the judge.
This is after EACC told the court that the properties and funds in question are proceeds obtained through illegal contracts awarded to the Governor (pictured), after influencing the contract awards to his company for supply of oil.
Onyiego dismissed the submission by Lenolkulal’s lawyer Paul Nyamodi that EACC has not established a link between the alleged proceeds of crime and acquisition of the property in question.
The court said the only defence given by the governor is that he did not influence the award nor was the award illegal, which will be ventilated when the trial begins.
