The Office of the Director of Public Prosecutions (ODPP) has withdrawn a case where two county government officials were accused of illegally listing ghost workers in the payroll.

Godfrey Kiriago and Geoffrey Nyamagwa were charged before Nyamira Resident Magistrate Beniah Okong’o on May 26, being the Director Human Resource and Payroll Manager respectively, jointly abused authority of their offices by arbitrarily listing Fred Nyakang’o and Joshua Kipkoech as a Civil Engineer and Senior Inspector respectively, purportedly recruited by the Nyamira County Public Service Board, an act prejudicial to the rights reserved by the employment agency.

The two were charged with 10 counts, all related to the illegal recruitment and loss of more than Sh1.5 million due to the irregular employment.

Case withdrawn

A letter by Joel Chirchir, the Senior Assistant Director of Public Prosecutions asked that the matter be withdrawn.

“I have considered the prosecution’s application in the matter and find the same to be merited. The charges against the persons herein are hereby withdrawn and the accused persons are hereby discharged forthwith,” the court ruled.
