Ruling: Court now gives nod for Ken Okoth’s burial
Kibra MP Ken Okoth’s cremation set for Saturday will now go on as planned after his family and the woman claiming to be his second wife, Anne Thumbi filed a consent in court.
A Nairobi court on Friday adopted the consent signed by Okoth’s mother Angeline Ajwang and Okoth's wife Monica Okoth allowing Anne Thumbi and her son, who she alleges to have sired with the late MP, to participate in the funeral arrangements.
The family also consented to have the Okoth's DNA samples collected before the body is cremated to confirm the paternity of Thumbi's five-year-old son.
“By consent read over to counsels on record and confirmed to be a true record by the parties, the consent is hereby adopted by the court,” ruled Commercial senior principal magistrate Grace Ayuma Mmasi.
The magistrate, consequently, set aside an earlier order barring Okoth's cremation or burial until the matter is resolved.
Speaking to the press after filing of the consent, lawyer Danstan Omari representing Thumbi said the dispute by his client was about the DNA samples and the child be allowed to participate in the funeral arrangements.
“Both parties have engaged in midnight discussion and we are glad we came to an agreement,” he said.
Lawyer and ODM secretary general Edwin Sifuna for Okoth’s mother said there was no dispute, and that the MP's mother has consented to DNA samples being taken.
