Uhuru will not bow to cartels – CS Munya defends President from Maraga, Mutunga
Agriculture CS Peter Munya has defended President Uhuru Kenyatta over his refusal to appoint six judges from the list forwarded to him by the Judiciary.
According to Munya, the constitution should give the Head of State room to exercise discretion on matters of national interest.
"If the work of the President is to rubber stamp what is brought before him saying it is the choice of the people, then the constitution should be changed," Munya said.
In his argument, the CS argued that the attacks by former Chief Justices David Maraga and Willy Mutunga were incessant and unmerited attacks.
"When cartels come together with a plan and give the president a list, his work is to just gazette and act as a rubber stamp," Munya said.
The CS further argued that Uhuru was within his constitutional limits to question the integrity of the six judges left out in the recent appointments.
Munya's sentiments come after ODM party leader Raila Odinga voiced his opinion on the standoff between the judiciary and executive.
In a statement Raila released on Saturday, June 12 the former premier stressed on the constitutional doctrine of Separation of Powers sighting it as one of the reasons behind the drive for the 2010 Constitution.
"Before we gave ourselves the 2010 Constitution, we had gone through an era where this doctrine had been abused and the Executive branch of government had interfered with the functions of the other branches, making democratic governance impossible," the statement read in part.
