The courts said I stay in office – impeached governor adamantly hangs on
For the umpteenth time, Impeached Wajir Governor Mohamed Abdi Mohamud has laid claim that he had been reinstated back to the office after being ousted by Wajir County Assembly and the Senate.
Addressing a press conference at a Nairobi hotel on Thursday, Mohamud claimed that a three-judge bench on Wednesday gave clear direction that “I continue to be in office to execute the powers and functions of the Governor of Wajir County as prescribed by the law until the petition is heard and determined”.
“Yesterday evening at around 6.30pm at Meru high court, the three Judge bench gave clear direction on the matter that was before them and ordered that on extension or clarity of the orders of 18th of May 2021,” Mahamud told journalists Movenpick hotel, Westlands accompanied by a handful of supporters.
He went on: “They say that, they see from the record that orders issued pending the inter parties hearing of the application dated the 18th of May 2021 and were confirmed to be in force on 24th of May 2021, those orders remain in force”
“The import of this order is that the entire findings and resolution of the Senate to remove me from Office was rendered ineffective, inapplicable and non-operational,” he added.
The ousted governor explained that anything done pursuant to the resolution of the Senate of May 17th 2021 including the purported swearing in his Deputy Governor Ahmed Muktar as the Governor of Wajir and any function performed was declared null and void and is of no effect and is a contempt of court.
A fortnight ago, Muktar re-organized his administration where a host of CECs were reshuffled included Ibrahim Abdi Mohammed, who was moved to head Finance Department, Ismail Sheikh Issak to health services, and Hussein Sugow Gedi to education.
Yussuf Abdi Gedi took over the agriculture and livestock docket from the ICT and Trade office; Ahmed Sharif Bulle took over the new ICT and trade from the agriculture and livestock docket.
Chairman of Council of Governors (COG) Governor Martin Wambora dismissed the new appointments claiming that it had already been annulled by the courts.
Mahamud decried continued disobeying of court orders in his matter saying it not stopped it will culminate to anarchy and lawlessness.
“I Just want to remind you on the several court orders issued which were not obeyed specifically the orders issued on 18th May 2021 and 24th May 2021 which were referred to by the judges and that I remain in force,” Mahamud said.
