Obure, Ouko to be charged with failing to secure firearm
A Nairobi court yesterday ordered businessman Chris Obure and his bodyguard Ouko to be charged with failing to secure a firearm and being in possession of it without license.
Milimani Senior Principal Magistrate Synkiyan Tobiko at the same time deferred plea taking until this morning (Friday) to enable the two to answer to the new charges against them.
The plea taking was scheduled to be conducted yesterday but it could not proceed since Obure was not present in court as he was said to have been taken to Riruta to be tested for Covid-19 before pleading to the charges of failing to secure his firearm.
According to the charge sheet on August 21 at Senteu Plaza while Obure being a licensed firearm holder allowed his firearm to be used by Ouko to commit murder.
Ouko on his part is charged with being in possession of firearm and ammunition which was used to commit murder without a firearm certificate.
The offence is said to have been committed on August 2 at Colana Suites, House along Colana road in Kilimani area, Nairobi.
The two have already been charged with murdering Kevin Omwenga. They have since denied the charge and are waiting for their bail application to be heard on Monday.
Kibera senior principal magistrate Derick Kuto on August 25, 2020 directed that Obure and Ouko be detained for 12 days, which lapsed on September 4, 2020, pending police probe over the incident.
The prosecution, in a miscellaneous application then, had sought for 14 days to detain the two suspects saying Investigating Officer Bashir Boya was yet to record statements from the key witnesses as well as take finger prints, photo profile and take the two suspects for DNA sampling for analysis by the government chemist.
Ouko, who is Obure’s personal bodyguard is not a licenced gun holder.
