3 Mombasa residents sue Chebukati over postponement of governor election

Three Mombasa residents have filed a petition seeking to compel Independent Electoral and Boundaries Commission (IEBC) to conduct an election for the Mombasa gubernatorial race within 14 days.

The trio namely Thank Mohamed, Moses Aran, and Kevin Nzuki in a petition filed before Mombasa High Court have sued IEBC Chairman Wafula Chebukati, the Ministry of Interior, and the Attorney General.

"On August 17, 2022, the respondent postponed the election for the position of governor of Mombasa County indefinitely citing alleged harassment, threats, and intimidation of its staff based at the National Tallying Center at Bomas of Kenya in Nairobi which has no connection with the IEBC officials located in Mombasa," the petition read in part.

They added: "The IEBC has not indicated at all if there is a breach of peace in Mombasa County or the other seven electoral areas and that the 3rd respondent (Interior Ministry) is not able to offer security so as to warrant the postponement of the elections."

IEBC postponed the governor seat election in Mombasa and Kakamega following ballot papers mix-up.

On Wednesday, August 17, the electoral body further postponed it citing insecurity after its staff members were attacked at Bomas of Kenya during the announcement of the presidential election.
