It’s absurd that the Supreme Court rubbished our evidence – Kalonzo

Wiper party leader Kalonzo Musyoka on Monday, September 5, criticized a ruling by the Supreme Court on the presidential election petition terming it an absurdity.

Kalonzo, in a statement issued hours after a seven-judge bench unanimously dismissed the petition filed by his Azimio la Umoja - One Kenya coalition partner Raila Odinga, said he respects the decision of the court although he disagrees with it.

He accused the court of ignoring the evidence tabled by the Azimio team, insisting that the documents were not fabricated, as stated by the bench.

"Following the decision of the Supreme Court on the Presidential election held on August 9, 2022, I would like to state that even though I do not agree with its findings, I respect the decision of the court.

"The course for justice and the fight for democracy in our nation remains a continuous journey and process, it is absurd and indeed disturbing that core evidence and pertinent issues raised by our lawyers as to the handling of our elections have been rubbished and deemed fabricated by the Supreme Court," the statement read in part.

Kalonzo's push for electoral reforms

Kalonzo vowed to continue fighting for democracy in the country despite the setback.

"This is a sad day for many Kenyans but it does not mean that the fight for a free and fair election is over. Kenyans are a resilient people and although divided right in the middle, owing to the tight contest, by God's grace, we shall prevail," Kalonzo added.

Earlier, Raila and his running mate Martha Karua expressed a similar stand.

"We have taken note of the decision of the Supreme Court on the Presidential election held on August 9th, 2022. We have always stood for the rule of law and the constitution. In this regard, we respect the opinion of the court although we vehemently disagree with their decision today," Raila said.

The former prime minister maintained that the August 9 presidential poll was not credible.

"Our lawyers proffered irrefutable evidence and the facts were on our side, unfortunately, the judges saw it otherwise. We find it incredible that the judges found against us on all nine (9) grounds and occasions resulted in unduly exaggerated language to refute our claims," he added.

"This judgement is by no means the end of our movement, in fact, it inspires us to redouble our efforts to transform this country into a prosperous democracy where each and every Kenyan can find their full belonging."

In a judgement read by Chief Justice Martha Koome, the court unanimously ruled that the presidential election was conducted in line with the country’s constitution and that Ruto won fair and square.
